Banking/Financial Services Litigation
Our practice in banking and financial services litigation is primarily focused on assisting banks, lending institutions and creditors recover their losses on bad loan portfolios and unpaid accounts. We also have experience in sub-prime lending claims. In determining whether to pursue a debtor, we routinely use computerized databases and asset search modules, private investigators and, where appropriate, asset and accounting analysis. To obtain leverage to create a favorable settlement environment, we often utilize prejudgment remedies such as real estate and bank account attachments, reach and apply claims, so-called “stranglehold” injunctions, and claims for fraudulent conveyances. Depending on the matter, we are also open to billing arrangements apart from the traditional hourly rate, including contingencies and flat fees.
